Companies to pay minimal annual tax between 2,200 and 43,000 lei

Companies will pay a minimal annual tax ranging between 2,200 lei (some 500 euros) if the have annual overall revenues lower than 52,000 lei and 43,000 lei (some 10,000 euros) if they have revenues higher than 129 million lei, according to the draft emergency ordinance on budget rectification on 2009 and the regulation of some financial-fiscal measures, that are to be approved on Saturday by the Government.
The companies which have overall annual revenues ranging between 52,001 and 215,000 lei will pay a minimal annual tax of 4,300 lei (some 1,000 euros) and the companies with revenues ranging between 215,001 and 413,000 lei will pay a minimal annual tax of 6,5000 lei (some 1,500 euros).
For annual revenues of 430,000 - 4.3 million lei the minimal tax will be of 8,600 lei (cca 2,000 euros), for annual revenues ranging between 4.3 million and 21.5 million lei the minimal tax stands at 11,000 lei (2,500 euros), for annual revenues ranging between 21.5 million and 120 million lei the minimal tax will be of 22,000 lei (5,000 euros).
Commercial companies, which report profit, will continue to pay a 16-percent, but not lower than the minimal limit for the interval of annual revenues in which they are included.
For the calculation of the minimal tax due to be taken into account are total revenues obtained from any source, registered on December 31 of the previous year from which are deducted the revenues from the variation of stocks, revenues from the production of corporal and non-corporal immobilizations, operational revenues, representing the quota of governmental subsidies and of other resources for the financing of investments, revenues from the reduction or cancellation provisions for which deduction was not granted, according to legal provisions, revenues resulted from debt cancellation and rises owed to the state budget, which were not deductible expenditures to the calculation of taxable profit, according to the law, revenues obtained from compensations from insurance companies, non-taxable revenues expressly stipulated in agreements and memorandums approved by laws.
According to the analyses carried out by the Ministry of Public Finance, in 2007, out of the 617,525 companies taxpayers, 2,000 provide 85% of the public revenues. The number of companies that reported losses in 2007 was of 242,106 (39.2% of the overall registered companies), considering these companies' turnover amounts to 134 billion lei.
