Registry of intra-community operators comes into force on August 1

The Ministry of Public Finance, on the basis of the methodological norms in force, mentions the persons that must produce the criminal record with a view to getting their names included in the registry of intra-community operators, which comes into force on August 1, 2010.
In the case of the joint stock companies, the limited liability companies included, which carry out their economic activity in Romania, they will only produce the criminal record of the administrator, therefore not the one of the associates too, with a view to getting their names included in the registry of intra-community operators.
Public institutions, such as the ones stipulated by Law No 500/2002 on pubic finance, with the subsequent amendments and additions, as well as any other taxable persons, no matter whether they are established in Romania or not, which are not set up on the basis of the republished Law No 31/1990 on trading companies, with the subsequent amendments and additions, do not have to produce the criminal record with a view to getting their names included in the registry of intra-community operators.
The registry of intra-community operators is set up and organized as part of the National Agency for Fiscal Administration and includes all taxable persons and the non-taxable legal persons, which carry out intra-community operations. It is one of the measures taken by the Government with a view to combating fiscal evasion and provides for the compulsoriness of getting one's name included in the above-mentioned registry in order to be able to carry out intra-community operations before they are actually carried out.
