The Commission for Budget – Finances : the majority of the provisions in OUG50 to be applied only for new loans

The deputies in the Commission for Budget, Finances and Banks approved on Wednesday the application of the majority of the provisions in the ordnance regarding population loans only for contracts which were signed after the coming into force of the document.
The deputies of the commission approved the application of some provisions OUG 50 only for new credits.
The provisions of the present emergency ordnance do not appliy to the contracts underway on the date when the present ordnance came into force with the exception of provisions from art.66-69 and as regards the contracts on non-definite duration which existed at the respective date of the present ordnance, of provisions art.37(1), art.50-55, art.56 line (2), art.57 line (1) and (2), art.66-69 and art.70-71 in the present ordnance' according to the amendment approved by the deputies.
The amendment includes that additional documents signed with a view to ensuring the conformity of the loan contracts with the provisions of ordnance 50 have come into force in conformity with the terms agreed between parties.
At the same time, the additional documents non-signed by the clients, considered approved according to art.95 of OUG 50 come into force in conformity with the terms in which they were formulated ' with the exception of the case when the consumer or the creditor notifies the other part on the contrary within 60 days since the coming into force of the present law'. The amendment was approved with 15 votes for, 5 votes against and 3 abstain.

Dissatisfied bank clients want to file a complaint with the MPs or the Ombudsman to fight against the decision of the MPs in the commission for budget in connection with the application of the ordnance regarding loans only for the contracts signed after the coming into force of the document. He considers that the article which provides the application OUG 50 only for new credits impeaches on 11 articles of the Constitution, for example in connection to the application of the law and the general principles of law. The PNL MP Eugen Nicolaescu stated that his party will try to amend the law for OUG 50 in the plenary of the Deputies' Chamber and he cannot do it, he will attack it with the Constitutional Court.
