AmCham Romania supports Gov't initiative to amend labour legislation

The American Chamber of Commerce in Romania (AmCham Romania) is supporting the Government's initiative to amend the labour legislation and reiterates the importance of substantial changes to the benefit of all parties involved: employees - employers - Government, AmCham reports in a press release.
Through its nearly 150 proposed amendments to the Labour Code submitted to the Ministry of Labour, Family and Social Protection during the public consultation period, AmCham Romania promotes four major principles: enforcing performance as basic principle with regards to labour relations; flexible labour relations; applying the collective bargaining agreement concluded at industry level only to signatory parties and removing the provisions related to the national collective bargaining agreement; clearer and simpler legal provisions.
In this context AmCham proposed the inclusion of performance among the governing principles of the labour relations, including for hiring and dismissing employees. Considering performance in the hiring process refers to providing a probation period that will allow the employer to thoroughly assess the potential of the employee, and, at the same time to enable the employee to decide the extent to which he or she is fit for one employer and his or her competitiveness working for the employer.
To address the needs of both employers and employees as detailed above, AmCham considers that the following measures are necessary: providing for a longer probation period, both in cases of unspecified individual employment contracts, and also for temporary individual employment contracts; the possibility for all new employees to go through a probation period, regardless of the number of previous employees going through probation periods for the same position; the possibility for employees to go through a probation period following the completion of initial professional training; in case the employee is included in such programmes and their timing coincides with the probation period, this does not meet its objective, as detailed above.
Prime Minister Emil Boc on Friday said the Government might pass the new Labour Code by assuming responsibility for it before Parliament, but the idea has to be discussed within the ruling coalition. On the other hand, the executive boards of the trade union federations making up the five nationwide representative trade union confederations of Romania are expected to meet today to agree on a schedule for joint actions.
PM Boc: Labour Code most often adopted by Govt's taking responsibility
Prime Minister Emil Boc said after talks with members of the national minorities' group in Parliament on Monday that the decision related to the manner in which the Labour Code will be adopted is to be made by the Government after consultations with the ruling parliamentary groups; he stressed, however, that the Labour Code versions had been most often passed by the Government's calling a vote of confidence, or taking responsibility for it.
'When the current Labour Code was adopted in 2003 (by the Social Democrat Adrian Nastase Gov't - editor's note) a vote of confidence was also sought. The various interests surrounding the Labour Code are difficult to harmonise and it is by such a procedure that the various Code articles can be backed and promoted and made coherent', Boc explained.He warned that choosing the regular parliamentary procedure would entail the risk of not adopting a coherent Labour Code.
Trade unions' protest agenda is scheduled
Unions threaten with a general strike in the first day when the President will receive the Labour Code and the Social Dialogue Code for promulgation and they promise, starting February 28 that they will launch rallies across Romania.
According to the action plan, all federations affiliated to the five confederations, will start, as of February 28 protests across Romania and in Bucharest the day when the Chamber of Deputies is to discuss the draft law modifying the Labor Code news agency Mediafax informs.
Union leaders announced that they set talks with deputies in the committee, protests and visits at the main party headquarters including the ruling party and the opposition, rallies across Romania and a warning strike the day of the vote in the Chamber of Deputies. At the local level, unions plans to rally starting February 28 to April 18 across Romania.
