New law on car tax, in force starting on Saturday; its effective implementing, after rules approval

The new law on the car pollution tax will come into force at the end of this week, but the effective implementing will only be possible after the Government approves the implementing rules, according to the information remitted on Wednesday to Agerpres by the Environment and Forestry Ministry (MMP).
The new law was released in the Official Gazette on Tuesday and is going to effectively come into force in maximum three days from its release, as there were not any additional specifications.
According to MMP, the actual implementing of the law will only be possible after the Government approves the necessary methodological rules in the weekly meeting.
The Environment Ministry added that the approval of the implementing rules for the new car pollution tax could be given either in the Wednesday Government meeting, or in the meeting at the Victoria Palace next week.
The new law provides a pollution tax reduction of up to 25 percent, giving the possibility, in case the pollution tax paid since July 1, 2008, is higher than that resulted from this law's implementing, to the contributors to request the refund of the amounts representing the difference from the tax paid.
In this respect, the persons who paid larger amounts in the account of the pollution tax than the amounts resulted from this law's implementing can go to the fiscal offices in charge to request the refund of the amounts representing the tax difference, according to law.
In accordance with the law, grounded on the 'polluter pays' principle, the pollution tax will be paid by the buyer at the moment of the first ownership transcription of the vehicle, after the law's coming into force.
The pollution tax represents revenues to the budget of the Environment Fund, from which several environment projects are financed, among which the Car Scrappage Scheme, the Green House programme, the programme for the afforestation of degraded lands, ecologic reconstruction and sustainable forest management, the national programme for the environment quality improvement through the development of green spaces in localities, etc.
The draft law concerning the tax on car polluting emissions was approved in December last year in the Deputies' Chamber plenum, by 213 to 17 votes and 34 abstentions.
In his turn, President Traian Basescu on January 5, 2012, promulgated the law concerning the tax on car polluting emissions.
The draft law was initiated by MMP following the European Court of Justice having declared the former car tax law as discriminatory.
