Housing Law requires one-year minimum rental contract duration

According to the new law package on housing, housing rental contracts shall be signed for a minimum duration of one year and should the parties not agree on the terms of the contract's renewal, the tenant shall leave the house upon the expiry of the agreement.

'This law package will settle the conclusion of rental contracts and the tenant-landlord relations in a fair manner for both parties,' Minister of Development, Public Works and Housing Laszlo Borbely told a press conference. The new package includes a law that regulates the general framework for residence building and the management of the residential stock, a law on house rental, another on landlord associations and a law on residences developed under public-private partnerships. Under the law, the effects of the rental contract signed over a specified length come to end at the term mentioned in the contract. The novelty about the normative act is the possibility to terminate the contract with a six-month written notice upon the landlord's initiative and a three-month written notice upon the tenant's initiative. The monthly rent can be freely established by negotiation between the landlord and the tenant. For residences fully or partially financed from public subsidizes, no matter if under public or private property, the rent shall not exceed the reference rent in the respective locality, to be established by the local authority based on rent listing.
