Nestor and Musat win the oldest trial in Romania

Law firms Nestor Nestor Diculescu Kingston Petersen (NNDKP) and Musat&Asociatii, two of the top law firms in Romania, won a trial launched in 1983 by local company Metalexportimport against Thyssen Krupp Steel, Otto Wolff Handelsgesellschaft GmbH, and Otto Wolff America.
A fourth company was also sued, but went bankrupt in the meantime.
Metalexportimport initiated the trial asking for 37.5 million pounds in damages - the value of 68.246 tons of heavy plate metal that it allegedly delivered but for which it received no payment. The total costs of the litigation, including lawyer fees, depositions, and legal stamp fees, could amount to 3 million euros, according to an estimate made for Business Standard by NNDKP Senior Partner Ana Diculescu Sova: 'There has been no similar trial, a 25-year legal battle, in Romania in the past 70-100 years,' she added.
Thyssen Krupp Steel is a shareholder of local Compa Sibiu car parts producer. 'One of the case's features is that the Romanian courts decided at some point to foreclose Compa, of which Thyssen Krupp is a shareholder, although the two are separate entities. This is unacceptable from a judicial point of view,' Musat&Asociatii co-Managing Partner, Ion Dragne, told Business Standard.
